Philanthropy News Digest (PND), a weekly news service of the Foundation Center, is a compendium, in digest form, of philanthropy-related articles and features culled from print and electronic media outlets nationwide.

Each PND abstract summarizes the content of, or from, an original article, press or news release, or grantmaker Web site. Many abstracts also include “FCnotes,” which provide basic fiscal information from the Foundation Center’s database regarding a grantmaker or grantmakers mentioned in the original news source. The information supplied in an FCnote is the most current available, and may represent information not yet published in print form that is subject to additional Foundation Center verification procedures. What is the estate tax?
The federal estate tax is a tax on the transfer of large amounts of money. When someone dies, his or her assets (the person's estate) are distributed to heirs. If the total value of the estate is large enough, an estate tax is imposed before the assets are distributed. In 2003, the net value of an individual's estate must exceed the basic exemption of $1 million, with a $2 million exemption for couples. As part of President Bush's 2001 tax cut, this exemption will gradually rise to $3.5 million for an individual ($7 million for couples) by 2009. Currently, with planning, small business owners can pass on $5 million tax-free. For farms, that figure is $8 million.

The estate tax and charitable giving
By excluding an unlimited amount for charitable giving, the estate tax offers a valuable incentive to donate to charity. One-third of private foundation revenues come from estate tax giving. Minnesota benefits greatly from private foundation grants made possible by the incentive of the estate tax. $200 million in grants are made each year by Minnesota foundations that would not exist but for the estate tax - endowed by donors that made lasting contributions for years to come.

In 1999, estate tax filers in the U.S. paid $28 billion in gift and estate taxes, and made charitable bequests of nearly $15 billion. Higher education institutions, museums, religious groups, and many human service organizations will be directly affected if the estate tax is repealed. It is estimated that their revenues through bequests and donations could decline as much as 23 - 40% under repeal, which will mean a loss of $10 billion annually.

Estate tax repeal: devastating impacts to Minnesota charities
In Minnesota, repeal of the estate tax would translate to a loss of $197 million per year in charitable giving (based on 2001 charitable bequest data), or an average of $33,708 per charity. Repeal of the estate tax would have a devastating effect on charitable contributions and greatly reduce the number of new foundations being created. The nonprofit sector is important to Minnesota for the services, culture, and education it provides, and the economic development it creates.

Complete repeal of the estate tax would be bad for our democracy, our economy, and our society. Elimination of the estate tax would reduce federal revenue by nearly $1 trillion over the next two decades, lower Minnesota tax revenues, and have a devastating impact on charitable giving. As a constructive part of the U.S. tax structure for 85 years, the estate tax does not prevent families from passing on wealth to their heirs, and encourages charitable giving. With federal deficits exceeding $400 billion per year, complete repeal of the estate tax would irresponsibly expand the enormous national debt for future generations of Americans and reduce resources available for local communities.

FTC Issues Consumer Publication on Charity Scams  

The Federal Trade Commission has issued a new consumer publication, ³Charitable Donations: Give or Take?², advising consumers on how to avoid potential charity scams. With more than 700,000 federally recognized charities soliciting for charitable contributors, it pays to be cautious when making a donation.

The publication, available at http://www.ftc.gov/bcp/conline/pubs/tmarkg/charity.htm, provides tips for consumers when donating to charities:

·         Some charities hire professional fund-raisers to solicit donations.

Professional fund-raisers are entitled to keep a portion of the money they collect. If you are solicited for a donation, you might want to ask if the caller is a paid fund-raiser and what percentage of your donation the fund-raiser will keep. If you are not comfortable with the amount, you may want to donate to a different organization or send a check directly to the charity.

·         If you do not want additional telephone calls from a paid fund-raiser, you can ask to be placed on the fund-raiser¹s ³do not call² list. If the fund-raiser calls again, they may be subject to a fine of up to $11,000.

·         Typically, when you donate to a charity, your name is placed on the charity¹s mailing list. The charity uses this list to re-contact you and often rents it or exchanges it with other organizations. You can stop the sharing of your information by including a note with your donation asking the charity not to rent, sell, or exchange your personal information and donation history.

·         Be wary of appeals that tug at your heart strings, especially pleas involving patriotism and current events.

·         If the solicitation is by phone, ask for written information about the charity, including its name, address, and telephone number.

·         Call the charity. Find out if the organization is aware of the solicitation and has authorized the use of its name. If not, you may be dealing with a scam artist.

·         Watch out for similar sounding names. Some phony charities use names that closely resemble those of respected, legitimate organizations.

·         Ask how your donation will be distributed: How much will go to the program you want to support, and how much will cover the charity¹s administrative and telemarketing costs?

·         Refuse high pressure appeals. Legitimate fund-raisers will not push you to give on the spot.

·         Avoid cash gifts. Cash can be lost or stolen. For security and tax record purposes, it is best to pay by check.

If you believe an organization may not be operating for charitable purposes, is making misleading solicitations, or is ignoring requests to be placed on a ³do not call² list, contact the Federal Trade Commission, your state Attorney General, or your local consumer protection office.
